ACT FOR PEACE’S TREK FOR REFUGEES 

Terms and Conditions

 

Please read these terms and conditions carefully. In registering for the Act for Peace Trek for Refugees, You hereby agree that You have read and understood these conditions.

Looking after your health and safety during the Event and fundraising within the law are both incredibly important. Please make sure You thoroughly read the guidance below to keep safe and legal during the Event. DEFINITIONS

 

Event means the ‘Trek for Refugees’ organised by Act for Peace. Although the ‘Trek for Refugees’ will occur during 12-18 August 2022, it encompasses all activities related to the ‘Trek for Refugees’, including activities undertaken prior to, during and after the ‘Trek for Refugees’. 

Act for Peace means Act for Peace Ltd ABN 86 619 970 188 and includes its Personnel.

Participant or You means an eligible entrant who has registered to participate in the Event. 

Personnel means Act for Peace’s employees, directors, officers, agents, contractors, sub-contractors, sponsors and volunteers. 

 

ENTRY REQUIREMENT

 

By accepting these terms and conditions, You are confirming that You are over the age of 18. 

The Participant’s entry into the Event is personal and the Participant has no right to transfer or assign that entry. Act for Peace, may, in its absolute discretion and without giving reasons for its decision, accept, refuse or cancel an application for registration. In such instances donations received by Act for Peace would be forfeited. 

 

CONDITION OF PARTICIPATION

 

By accepting these terms and conditions, You agree that You are responsible for ensuring your own  health and safety in participating in the Event and warrant, as a condition of entering the Event that You have adequately prepared to participate in the Event and that You are not aware of any illness, injury or other physical disability which may cause illness, injury or death whilst participating in the Event. 

You acknowledge that it is your responsibility to consult an appropriate medical professional to determine whether You are fit to participate in the Event and to address any illness, injury or other physical disability which may impact your ability to participate in the Event without risk.

If You become aware of any medical condition or impairment or are otherwise sick or injured prior to or during the Event, You confirm that You will cease participation in the Event until You have sought appropriate medical advice. 

You must not rely on the information provided by Act for Peace as an alternative to medical advice from Your doctor or other professional healthcare providers.  

 

ACKNOWLEDGMENT, INDEMNITY AND RELEASE

 

By taking part in the Event, You fully acknowledge that You are responsible for Your own health and safety while participating in the Event and undertakes the risks involved. 

 

FUNDRAISING ON BEHALF OF ACT FOR PEACE

All Your fundraising activities must align with Act for Peace’s mission, vision, purpose and values.

By accepting these terms and conditions, You also agree that You have read and understood our Marketing, Communications and Fundraising Policy and agree to follow all provisions laid out within.

You understand that Act for Peace reserves the right to withdraw your authority to fundraise at any time if the fundraising event or activity doesn’t align with the Marketing, Communications and Fundraising policy, negatively affects Act for Peace’s reputation, or You do not meet any of the agreed-upon terms and conditions. 

 

FUNDRAISE WITHIN THE LAW 

 

All your fundraising activities must comply with all relevant national, state and territory laws and regulations.

By accepting these terms and conditions, You accept it is your responsibility to comply with the applicable fundraising laws in your area, and where appropriate, comply with additional regulations including, but not limited to, liquor licensing, food preparation and holding raffles or auctions.

Please make sure You familiarise yourself with the regulations that apply to your fundraising activity. 

 

CODE OF CONDUCT

 

By taking part in the Event, it is expected that the You will:

  • be cooperative participants throughout the Event, adhering to the instruction of Event organisers 
  • treat people with courtesy, respect and proper regard including those involved in the Event and the wider community
  • ensure a safe environment
  • ensure protection of others from harassment and intimidation
  • behave in a manner that is fair and non-discriminatory towards others
  • walk the trail in a safe manner ensuring safety of others, the environment and self

The following behaviour will not be tolerated:

  • violent and abusive behaviour
  • harassment and intimidation
  • public disturbance
  • theft
  • arson
  • vandalism (cultural and environmental)
  • excessive consumption of alcohol and acting in a way that becomes a public nuisance or creates a public disturbance.

 

CHILD SAFEGUARDING POLICY

 

Act for Peace is committed to the safety and well-being of all children. We take our duty of care seriously and will aim at all times to provide the safest possible environment for children. We will take all concerns and reports of child abuse seriously and immediate action will be taken. 

By accepting these terms and conditions, You also agree that You have read and understood our Child Safeguarding Policy and agree to follow all provisions laid out within.

 

PREVENTION OF SEXUAL ABUSE, EXPLOITATION AND HARASSMENT POLICY

 

Act for Peace has zero tolerance of all forms of sexual exploitation, abuse or harassment, and is committed to maintaining a safeguarding environment and to responding to concerns. This Policy outlines our commitment and provides information on how to report any concerns. The Policy is to be read in conjunction with our Child Safeguarding Policy (where children are affected).

By accepting these terms and conditions, You also agree that You have read and understood our  Prevention of Sexual Abuse, Exploitation and Harassment Policy and agree to follow all provisions laid out within.

 

DATA COLLECTION POLICY

 

Your privacy is important to us. Act for Peace collects your personal information in order to keep You informed about our projects, activities and opportunities to take action. By providing your information You are agreeing that Act for Peace may use it to contact You in the future. You can opt out of future communication or contact us with any queries, by emailing info@actforpeace.org.au, calling 1800 025 101 or writing to act for Peace, Locked Bag Q199, QVB NSW 1230. To reduce overheads we may provide your information to trusted suppliers  who provide services on our behalf (including mail, data, phone, IT, processing and research). Our privacy policy is available at www.actforpeace.org.au/privacy and contains information about (i) how we collect, store and use, plus how You can access and correct your personal information; (ii) how You can lodge a complaint regarding the handling of your information; and (iii) how any complaint will be handled by Act for Peace. 

 

PERSONAL INFORMATION

 

The Participant acknowledges that their image may be taken by Act for Peace during the Event, including but not limited to Event photographers and videographers.

The Participant agrees to allow their name, photographs, videos, multimedia or film likeness to be used for any legitimate purpose by Act for Peace without payment or compensation.

 

CANCELLATION OF EVENT

 

If, for any reason, the Event is canceled for any reason, any donations received by Act for Peace would be forfeited. 

 

GOVERNING LAW

 

These terms and conditions are governed by the law of New South Wales. 

 

SEVERABILITY

 

Part or all of any provision of these terms and conditions that is illegal or unenforceable may be severed from the terms and conditions and the remaining provisions of these terms and conditions continue in force. 

 

EFFECT OF TERMS AND CONDITIONS

 

These terms and conditions apply to the Participant’s participation in the Event. Entry into the Event is deemed acceptance of these terms and conditions. The Participant acknowledges and agrees that these terms and conditions are subject to change from time to time at the discretion of Act for Peace. 

If Act for Peace makes any substantive changes to these terms and conditions, including the collection or use of personal information, Act for Peace will notify the Participant of such changes as soon as practicable.
